Hello there,

We have Back & Front covers... and why not the Side-Artwork of the cover ?

99,99% of the time, the side-art of a DVD contains the title of the DVD.



Just imagine a DVD online list with side-artworks (original logo and typographie) instead of a plain text title.

Would be very cool, and very beautiful list IMHO.

this is impossible for legal reasons (printing out full covers for "backups")

It's a really nice idea, you could even create a sort of virtual shelf with all your DVDs lined up, clicking on the spine to go to the profile.
However, hydrox is right - it's not allowed for legal reasons. I believe the use of front and back can be covered through "fair use", but the addition of the spine would allow users to duplicate full covers and that puts Invelos on legally shaky ground.

Yeah, I've often thought that a virtual shelf would be nice. It's good to know that there's a reason it isn't going to happen.

Having (and distribute) a copy at 300DPI of the full cover is illegal. But what's about a low-resolution (artefacted by the JPEG format / for the web) one ?

Sometimes the law miss some things...

Did you have some official law texts ?

One could add the spine feature without it making contributable.

We have the ability to add pictures of the actors without having the ability to contribute them.

No, we don't. But having spent some many years in retail i do have some familiarity with the topic. But even more imporatantly Invelos has attorneys on retainer as do all companies and Ken has been advised of what is proper ad what is NOT. I suggets as politely as i can that you simply live with it.

But, as always what you can do Contribution wise and what you do locally are two totally different issues. You want Covers with spines, you can certainly have them, but you can't Contribute them. Thus any potential for legal liability rests on YOUR shoulders and not the shoulders of Invels or other users. Out of all the titles that I own,  have MAYBE a half a dozen which have been accepted from the Online for one reason or another. But nearly ALL of tyhe images in my database are images which were personally scanned by me. You can do that too.

What about user created images for the spines, would this not bypass the copyright issue??
If it does, then I would agree it would be an interesting alternative to text and allow the ability to have a virtual shelf.

Just curious where you got this information from?

Ken has stated that "Cover images for owners of the DVD is fair use. Photographs of the actors are not covered by fair use - the photographer has not been compensated."

Since you own the spine as well as the cover, why wouldn't it fall under "fair use" as well?

I'm not saying that it wouldn't fall under "fair use", but I'm sure it's not something that Invelos really wants to find out.
Currently, we have access to scans of the front and back covers. That means we are unable to reproduce the full cover as we are missing the spine.
The DVD companies are more likely to allow Invelos this use of their copyrighted material because of this inability to duplicate said material in full.
However, if we add spines to the online database, we are now giving people the possibility to duplicate copyrighted material in full.
The DVD companies may take umbrage to this and decide to sue Invelos based on the copyright laws. It is still possible that Invelos would win the case, but it would be very expensive, and in the interim the DVD companies could stop Invelos from sharing the images until the case is decided. And should Invelos lose, that would probably mean the removal of all images!

In short (too late!), it is possible that they would still be covered by fair use, but it's probably not worth the risk or the expense to find out!

Totally agree.
Besides, how could Invelos verify if a contributed spine is a user created image or the original spine?

I think the only way this could be incorporated into the program is if it was made local only. So there was a space for the spine scan, but it was never contributed with the rest of the profile.
Maybe if we generalised the idea:
what about if we asked for customised thumbnails instead? So instead of defaulting to the front image, we were allowed to add our own image for a profile's thumbnail, and in conjunction with changing the size of the thumbnail, some users could make the thumnail spine-shaped and scan the spines in - creating a virtual shelf!
